本条款约束你对谛听(Diting)App 及网站 diting.app(合称「服务」)的使用。使用服务即表示你同意本条款;如不同意,请勿使用。

1. 谛听做什么

谛听聆听设备附近的语音,将其转成文字、翻译,并生成谈话的文字记录与摘要。它是理解谈话的辅助工具,不是认证翻译或口译服务,不得作为此类服务使用。

2. 使用资格与账户

你须年满 16 岁。核心功能(实时字幕、转录与摘要)无需注册即可使用。你可以选择通过 Apple ID(Sign in with Apple)登录以开通云端同步;登录后,你负责保管好该 Apple ID 及账户下的全部活动。

3. 订阅

Diting Pro 为自动续订的订阅,可选按月(澳大利亚 14.99 澳元/月)或按年 (99.99 澳元/年,约合每月 8.33 澳元)。首次订阅按月付费的用户首月为 7.99 澳元, 之后按标准价续订;其他国家和地区按当地 App Store 价格结算。免费版每个自然月包含 10 分钟字幕时长,每月重置。费用在确认购买时从你的 Apple ID 账户扣除;除非在当期结束至少 24 小时前取消,订阅将自动续订。你可随时在设备的「设置 → Apple ID → 订阅」中管理或取消。删除 App 不等于取消订阅。

公平使用:Diting Pro 每个自然月最多 40 小时字幕、单次最长 2 小时;超出月度额度后,当月单次限 10 分钟。连续静音 5 分钟后会询问是否继续, 再无应答则在 10 分钟时自动停止并保存。这些限制是为了服务可持续,可能调整;当前用量始终可在 App 内查看。

4. 你的责任

记录或转写他人谈话在你所在地可能受法律约束(澳大利亚各州规定不同)。使用谛听前,你须自行取得所需同意并遵守全部适用法律。
我们建议你告知谈话对方正在生成字幕——手机放在桌上、屏幕实时显示字幕, 本身也让这一点显而易见。
不得用本服务偷录他人、骚扰任何人或用于任何非法目的。
不得对服务进行反向工程、干扰或过载。

5. 准确性

转录与翻译由机器自动完成,可能存在错误、遗漏或误译,尤其在口音、噪音、人名、数字和专业术语场景下。请勿仅依据谛听的输出做出法律、医疗、财务或其他重大决定,重要信息务必与对方当面确认。

6. 你的内容

你的谈话产生的转录和摘要归你所有。你仅授予我们为向你提供服务所必需的存储、处理和展示权限。我们不用你的转录内容训练模型,也不用于广告。你可随时在 App 内删除任意记录或整个账户。

7. 可用性与变更

服务按「现状」和「可用」状态提供。我们可能随时变更、暂停或终止服务的任何部分;也可能更新本条款——「最后更新」日期会相应变化,该日期后继续使用即视为接受新条款。

8. 责任限制

在法律允许的最大范围内,我们排除一切保证,且不对因使用或无法使用服务造成的任何损失负责,包括因转录或翻译不准确造成的损失。本条款不排除你依澳大利亚消费者法享有的不可排除的权利。

9. 终止

你可随时停止使用并删除账户。若你违反本条款,我们可暂停或终止你的访问。

10. 适用法律

本条款受澳大利亚维多利亚州法律管辖,你接受其法院的非排他性管辖。

Terms of Service

These Terms govern your use of the Diting app and the website diting.app (together, the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What Diting does

Diting listens to speech near your device, converts it to text, translates it, and produces a written transcript and summary of the conversation. It is an aid for understanding conversations. It is not a certified translation or interpreting service and must not be relied upon as one.

2. Eligibility and account

You must be at least 16 years old to use the Service. The core features (live captions, transcripts, and summaries) work without registration. You may optionally sign in with your Apple ID (Sign in with Apple) to enable cloud sync; if you do, you are responsible for keeping access to that Apple ID secure and for all activity under your account.

3. Subscription

Diting Pro is an auto-renewing subscription, available monthly (A$14.99/month in Australia) or annually (A$99.99/year, about A$8.33/month). First-time monthly subscribers pay A$7.99 for the first month and the standard price thereafter; other regions are charged at their local App Store price. The free tier includes 10 minutes of captioning per calendar month, which resets monthly. Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel it at any time in your device Settings → Apple ID → Subscriptions. Deleting the app does not cancel an active subscription.

Fair use: Diting Pro includes up to 40 hours of captioning per calendar month and up to 2 hours per session; beyond the monthly allowance, sessions are limited to 10 minutes each until the next month. After 5 minutes of silence the app asks whether you want to continue, and stops automatically at 10 minutes if there is no response. These limits exist to keep the service sustainable and may be adjusted; current usage is always visible in the app.

4. Your responsibilities

Recording or transcribing other people's speech may be regulated where you are. In Australia, laws differ by state and territory. You are solely responsible for obtaining any consent required and for complying with all applicable laws before using Diting in a conversation.
We recommend you let the people you are speaking with know that captions are being generated — the phone lying on the table with live captions visible also makes this apparent.
Do not use the Service to record people covertly, to harass anyone, or for any unlawful purpose.
Do not attempt to reverse-engineer, disrupt, or overload the Service.

5. Accuracy

Transcription and translation are automated and may contain errors, omissions, or mistranslations, especially with accents, background noise, names, numbers, and specialised terms. Do not make legal, medical, financial, or other significant decisions based solely on Diting's output. Always confirm important details directly with the other party.

6. Your content

You own the transcripts and summaries created from your conversations. You grant us only the limited rights needed to store, process, and display that content to you as part of providing the Service. We do not use your transcripts to train models or for advertising. You can delete any record, or your whole account, at any time from within the app.

7. Availability and changes

The Service is provided on an "as is" and "as available" basis. We may change, suspend, or discontinue any part of it at any time. We may update these Terms; the "Last updated" date above will change and continued use after that date means you accept the new Terms.

8. Limitation of liability

To the fullest extent permitted by law, we exclude all warranties and are not liable for any loss or damage arising from your use of, or inability to use, the Service, including loss arising from inaccurate transcription or translation. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

9. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms.

10. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.
